  • Who is on the hook for paying the settlement? (Broker’s/Companies 2+billion)
  • Will agents at those brokerages have to pay into the settlement? (Discussion on how fees and splits could possible change)

WHAT ARE THE CHANGES?

  • Commission offered to another broker on a listing may not be listed in the MLS listing.
  • “Required” written agreements for agents/brokers representing a buyer.
  • How commissions are communicated between agents, buyers, and sellers.

WHAT HASN’T CHANGED?

  • What is the purpose of the buyer/broker agreement, and why should you always use one?
  • There’s no set commission rate for buyers and sellers.
  • Commissions are negotiable.

THE BUYER BROKER AGREEMENT

  • Explaining the buyer broker agreement to your clients.
  • When it’s needed and what should be included in it.
  • Handling objections from buyers.

WHY DOES A BUYER NEED AN AGENT, AND WHY SHOULD THEY CHOOSE YOU?

BUT HOW AM I GETTING PAID?

  • It depends on how it’s negotiated.
  • The seller may still pay for both sides of the commission.
  • The buyer can also pay and/or receive a credit from the seller to pay the commission.

WHAT TO DO AS A LISTING AGENT

  • How can the NAR lawsuit be properly explained, and what it means for sellers?
  • Be honest about how agents are paid. (Commission conversation)
  • Make sure they are aware that you represent them for their listing. Representing them as a buyer or a buyer for their listing would require another agreement and payment for commission.
